General Terms and Conditions — Graphic Design Services
These terms and conditions govern the provision of graphic design services, including flyers, brochures, business branding, marketing materials, and digital content, as well as the relationship between the designer (the “Designer”) and the client (the “Client”).
This page is intended for clients looking for creative graphic design for business in the United States, including New York City, Brooklyn, and Manhattan.
By placing an order and submitting a deposit, the Client agrees to these terms regardless of whether they have been fully reviewed.
Project Start and Booking
• Design work begins only after the project scope is approved and a deposit is received. • Project details, formats, deliverables, and timelines are agreed upon before work begins. • All communication and approvals are confirmed in written form (email or messages).
Deposit and Cancellation
• A 50% non-refundable deposit is required to begin any design project, unless otherwise agreed. • The deposit covers research, creative development, and concept preparation. • If the Client cancels the project after work has started, the deposit is non-refundable. • If the project is cancelled due to the Designer’s fault, the deposit will be fully refunded.
Revisions and Approval
• The project includes one or two rounds of revisions, depending on the selected package. • Revisions do not include a complete change of concept or visual direction. • Additional revisions or major changes are billed separately. • The project is considered approved once written confirmation is received from the Client.
Timelines
• Project timelines depend on complexity and Designer availability. • Delays in Client feedback may affect delivery dates. • Rush projects are available for an additional fee and must be agreed upon in advance.
File Delivery and Storage
• Final design files are delivered via Google Drive, unless otherwise agreed. • Files are stored for three (3) weeks from the date access is granted. • The Client is responsible for downloading and saving all files during this period. • After three weeks, the Designer may permanently delete the files without notice. • Re-uploading deleted files is available for an additional fee of $30, subject to file availability. • Extended file storage is available for an additional fee by prior agreement.
Copyright and Usage Rights
• All design materials remain the intellectual property of the Designer until full payment is received. • Upon full payment, the Client receives usage rights for the agreed purposes. • The Designer may showcase completed projects in portfolios, on the website, and on social media unless otherwise agreed in writing.
Final Provisions
• Placing an order constitutes full acceptance of these terms and conditions. • The Designer reserves the right to update these terms at any time. The current version is always available on the website.
