Terms and Conditions of the photoshoot in New York
General Terms and Conditions
These terms and conditions govern the booking, payment, and conduct of photography services in New York City, including Manhattan, as well as the relationship between the photographer (hereinafter referred to as the “Photographer”) and the client (hereinafter referred to as the “Client”).
This page is intended for clients who are looking to book a photographer in New York, including Manhattan, for personal, family, children, and business photo sessions.
By booking a session and submitting a deposit, the Client confirms their full agreement with these terms and conditions, regardless of whether they have been read in full.
Booking a Photography Session in New York
• A photography session in New York City is considered booked only after a deposit has been received.
• The standard deposit is $50 for all individual and commercial photo sessions, unless otherwise agreed in advance.
• The deposit secures the selected date and time exclusively for the Client.
• Without a deposit, the date remains open and may be booked by another client.
Deposit and Cancellation Policy
• The $50 deposit is non-refundable.
• In the event of cancellation by the Client for any reason, the deposit will not be refunded, regardless of how far in advance the cancellation is made.
• The deposit compensates the Photographer for time spent on communication, planning, preparation, and reserving the date.
• One complimentary reschedule is allowed if the Client notifies the Photographer at least 48 hours before the scheduled session. The new date is subject to the Photographer’s availability.
• Any additional reschedule or a reschedule request made less than 48 hours before the session is considered a cancellation. In such cases, the deposit is forfeited.
Payment
• The remaining balance is due on the day of the session or before the session begins, unless otherwise agreed.
• Accepted payment methods:
– Zelle
– PayPall
– Venmo
– Cash
• Checks are not accepted.
Late Arrival and No-Show
• Late arrival by the Client does not extend the session time.
• If the Client is more than 20 minutes late without prior notice, the Photographer reserves the right to cancel the session. In this case, the deposit and any payments made are non-refundable.
• Failure to appear without notice is considered a no-show and treated as a cancellation.
Session Conditions (New York & Manhattan Photography)
• Photography sessions may take place in a studio, outdoors, or at another agreed location in New York City, including Manhattan.
• The concept, style, and format of the session are discussed in advance.
• The Client is responsible for personal preparation, including wardrobe, makeup, and props, unless otherwise included in the selected package.
• The Photographer is not responsible for the final result if the Client does not follow preparation recommendations.
Studio Sessions
• Once a studio is selected, the Photographer confirms the availability of required equipment and the dates requested by the Client.
• The Client is solely responsible for booking the studio, under their own name and directly with the studio.
• The Client is responsible for paying any deposits or rental fees required by the studio, in accordance with the studio’s policies.
• The Photographer is not a mediator or representative between the Client and the studio and is not responsible for the studio’s internal rules, cancellation policies, or refund decisions.
• If the session is cancelled or disrupted due to the Client’s actions, any issues related to studio refunds or fees must be resolved directly between the Client and the studio.
• If the session is cancelled due to the Photographer’s fault, the Photographer agrees to reimburse the Client for the studio rental deposit in full.
• Any damage to studio property (equipment, interiors, props) caused by the Client, the Client’s children, or animals is the Client’s full responsibility and is subject to the studio’s rules and policies.
Children and Family Photography Sessions
• When booking children photography, family sessions, or sessions involving animals (including dogs), the Client is fully responsible for supervising their behavior and ensuring their safety at all times.
• The Photographer is not responsible for injuries, stress, or unpredictable behavior of children or animals during the session.
• The outcome of sessions involving children or animals depends on their mood, condition, and interaction with the environment and cannot be guaranteed.
Editing, Retouching, and Photo Delivery
• RAW files are not provided, unless otherwise agreed in advance between the Photographer and the Client.
• After the session, the Client receives all captured images in JPEG format without retouching for personal selection of images for editing.
• At the Client’s request, the selection of images for retouching may be fully entrusted to the Photographer.
• The number of edited images is determined by the selected package or agreed upon separately.
• All artistic and technical editing is performed at the Photographer’s discretion and in their signature style.
• Editing turnaround times are agreed upon individually and depend on the scope of the session.
• Rush editing may be available for an additional fee, subject to availability.
File Delivery and Storage
Final edited photographs are delivered to the Client via a Google Drive download link, unless otherwise agreed. The photographs are stored on Google Drive for three (3) weeks from the date the Client receives the download link and access. During this period, the Client is responsible for downloading and saving the files to their personal device or storage. After the three-week storage period, the Photographer reserves the right to permanently delete the files without further notice. If the Client fails to download the photographs within the stated time frame, the Photographer is not responsible for loss of access. Re-uploading deleted pictures to Google Drive is available for an additional fee of $30, provided the files are still archived by the Photographer. Extended storage beyond three weeks is available for an additional fee and must be agreed upon in advance.
Copyright and Usage Rights
• All photographs remain the intellectual property of the Photographer.
• The Client receives usage rights for personal or commercial purposes, depending on the type of session booked.
• The Photographer reserves the right to use the images for portfolio, website, and social media purposes unless otherwise explicitly agreed in writing prior to the session.
Limitation of Liability
• The Photographer is not responsible for circumstances beyond their control, including but not limited to weather conditions, actions of third parties, or location restrictions.
• In the event of force majeure on the Photographer’s side, the session will be rescheduled or the deposit will be fully refunded to the Client.
Final Provisions and Photographer Booking Information
• Booking a session constitutes full acceptance of these terms and conditions and confirms the Client’s intent to book a photographer in New York City under the stated rules.
• The Photographer reserves the right to update or modify these terms at any time without prior notice. The current version is always available on the website.
